By using this website or purchasing products, you release High Melts and its affiliates from any liability resulting from misuse or failure to inform your medical professional of your use. Products are not intended to diagnose, treat, cure, or prevent any disease.

2. Eligibility & Account Requirements

  • You must be at least the legal age in your jurisdiction to access or purchase products. Users underage are prohibited.
  • Age verification may include photo ID and database checks.
  • You are responsible for your account and its security.
  • We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion.

10. Indemnification

11. Mandatory Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).

  • Parties must jointly select an arbitrator with at least 5 years’ experience within 10 calendar days of a dispute. If no agreement, AAA may appoint an arbitrator.
  • Arbitration decisions are final and binding, with no appeal except as provided by the Federal Arbitration Act (FAA).
  • Parties share arbitration costs unless the arbitrator orders otherwise.
  • The arbitrator cannot award punitive damages and may award attorney fees only as allowed by law or contract.

Class Action & Jury Waiver: All arbitration is individual. Parties waive rights to class actions, class arbitration, and jury trials. This provision survives termination of your agreement.

12. Governing Law & Jurisdiction

  • Governed by the laws of New York, without regard to conflicts of law.
  • Disputes shall be filed in Westchester County, NY, or the U.S. District Court for the Southern District of New York.
  • Mandatory mediation applies before court action.

13. Modifications to Services & Terms

  • Prices, products, and services may change without notice.
  • We are not liable for service modifications, suspensions, or discontinuations.
  • We may update these Terms at any time. Continued use constitutes acceptance of changes.

14. Severability

  • If any provision is found unenforceable, it will be severed, and remaining provisions remain in effect.

15. Termination

  • Terms remain in effect until terminated by either party.
  • We may terminate your access for violation of these Terms.

16. Entire Agreement

  • These Terms, along with our policies, constitute the entire agreement between you and High Melts.
